Determining time of death is both an art and a science and requires the investigator use several techniques and observations to make an accurate estimate. As a rule, the sooner after death the body is examined, the more accurate this estimate will be. A legal time of death is important in both criminal as well as civil court proceedings. Criminal – Goes to opportunity and access, can prove or disprove an alibi. Civil – Can assist in inheritance and probate issues. Time of death classifications Time of death falls into three distinct and legal classification. Each classification has its own set of parameters. Physiologic time of death When a person’s vital functions ceased Legal time of death The time recorded on the death certificate Estimated time of death The time the C/ME and investigation estimates that death occurred It is important to understand that the three times of death may differ by: Hours Days Weeks Even months or years For example, physiologic death can occur at 2200 hours Tuesday and the body not found until 1400 Wednesday. However, the last verified time known alive was 1700 Monday. These times would to be taken in account with making a final ruling. This issue can be a bit confusing. I explain these times and classifications in the short video.
