Discovery in a Florida Family law case takes place in two phases: Informal Discovery followed by Formal Discovery. Informal Discovery is what I call the collection of evidence done by the attorney, paralegal, and/or client prior to the initiation of a lawsuit. Formal Discovery begins once petition has been filed. Read Florida Family Law Rules of Procedure, Rule 12.280 for an overview of discovery. Formal discovery generally starts with Mandatory Disclosures (See Florida Family Law Rules of Procedure Rule 12.285 and Florida Family Law Form 12.932). You typically have 45 days to exchange mandatory disclosures. Review Florida Family Law Form 12.932 to see exactly what information must be disclosed. Mandatory disclosures include Financial Affidavits. See Florida Family Law Form 12.902(b) or 12.902(c). After Mandatory Disclosures, you can use one or more of the formal discovery instruments to gather additional evidence. Refer to the Florida Family Law Rules of Procedure to see how the various instruments of formal discovery (depositions, interrogatories, request for production of documents, requests for admission, etc.) are used.
