Flying With Weed - Everything That You Need To Know | Amin Law

With weed being legal in California, more and more people are showing up to airports like the Oakland International Airport hoping to bring their weed along with them. However, many people may not know that they can still face penalties for attempting to bring weed onto a flight, even though it may be legal in California. What happens if the TSA catches you with weed? Since marijuana is legal in California, the TSA will likely confiscate the weed should they find it during the screening process. However, they may still contact local authorities if the amount of weed in your possession is too high or if you are not of a legal age to possess it. If caught with illegal amounts of weed, you may face penalties pursuant to §11357 of the California Health and Safety Code. Section11357 prohibits the unlawful possession of marijuana in California. Adults age 21 and over are allowed to possess up to one (1) 28.5 grams of dried marijuana or eight (8) grams of concentrated cannabis (hashish). Possessing more than these quantities, or any possession by a minor under 21, or any possession at a K-12 school, are all prohibited by the statute. I’ve attached a table in the bio that summarized the current law and penalties regarding marijuana possession in CA: The following table summarizes the current laws and penalties regarding marijuana possession in California: Possession of marijuana or concentrated cannabis by people under 21 Infraction Drug counseling and community service (defendants under 18); fine of up to $100 (defendants 18 and over) Possession of more than 28.5 grams of marijuana or more than 8 grams of concentrated cannabis (defendants 18 and over) Misdemeanor Up to 6 months in county jail; up to $500 fine Possession of more than 28.5 grams of marijuana or more than 8 grams of concentrated cannabis (defendants under 18) Infraction Drug counseling and community service Possession of marijuana or concentrated cannabis on the grounds of a K-12 school (defendants 18 and over) Misdemeanor Up to $250 fine for first offense Possession of marijuana or concentrated cannabis on the grounds of a K-12 school (defendants under 18) Infraction Drug counseling and community service Teens & Alcohol: Know the law and the consequences when minors get involved with alcohol use and abuse. Fake IDs: If you are caught with a fake ID the penalty is a minimum $250 fine and/or 24-32 hours of community service OR maximum $1,000 fine and/or six months in the county jail PLUS…a one year suspension of your driver’s license. If you don’t have a license, you’ll have to wait an extra year to get one. Attempting to Purchase Alcohol: If you attempt to purchase alcohol, the penalty is a maximum $100 fine and/or 24-32 hours of community service, PLUS…a one year suspension of your driver’s license. If you don’t have a license, you’ll have to wait an extra year to get one. Possessing Alcohol: If you are caught in possession of alcohol, the penalty is a $250 fine and 24-32 hours of community service, PLUS…a one year suspension of your driver’s license. If you don’t have a license, you’ll have to wait an extra year to get one. Purchasing Alcohol: If you purchase alcohol, the fine is $250 and/or 24-32 hours of community service, PLUS…a one year suspension of your driver’s license. If you don’t have a license, you’ll have to wait an extra year to get one.
