On January 2nd, 2023, a drunk driver involved in a head-on crash on State Route 78 told officers he had done nothing wrong — even as the other driver fought for his life. When officers arrived, the scene was chaos. One driver was trapped inside his vehicle, feet pinned, requiring mechanical extraction. He was rushed to the hospital in critical condition. The other driver, Brian Bennett, was found being treated in an ambulance. During the conversation, he admitted he had been drinking beer a couple of hours before the crash. Later, at the hospital, officers observed Bennett appearing lethargic and struggling to stay awake. They conducted a Horizontal Gaze Nystagmus test while he remained in a hospital bed — all six indicators of impairment were present. When asked to provide a breath or urine sample, Bennett refused both. Officers had no choice. After being medically cleared, Brian Bennett was placed under arrest. The other driver did not survive. Brian Bennett was convicted of aggravated vehicular homicide, a first-degree felony. He was sentenced to 8 to 12 years in prison and is currently incarcerated at Marion Correctional Institution. He won't be eligible for parole until 2031.
