The ruling is on Ellison v. Willoughby, 2023 WL 7203352 (Fla. Nov. 2, 2023). It specifically establishes that a trial attorney cannot argue a client is entitled to relief under one statute, and then argue on appeal that client is entitled to relief under a different statute.
