Hell - No. For the same reasons that you don’t have to answer a cop’s questions, under NO circumstances are you required to unlock or give the cops your cell phone’s pass code. In fact, unless you’re foolish enough to give them access, if law enforcement wants to get into your cell phone, then they’re gonna need to get a warrant. Now the cops don’t need to tell you that, and they might even lie to you about it, saying that you have to unlock your phone or threatening to arrest you if you don’t... but I’m telling you that’s BS. The United States Supreme Court has ruled that for 4th Amendment Search and Seizure purposes cell phones are pretty much just like your home... If a cop wants in then they’re either gonna need to get a warrant or have an exception to the warrant requirement. I’m also telling you here and now that the most common exception to the warrant requirement is consent, and, unfortunately there are some unscrupulous who cops lie about getting consent. For example, you’re stopped for speeding, the cop asks for permission to search your car, you say no, he searches anyhow and then lies when he swears that you gave consent. In that instance the search done and the issue of your consent boils down to the cop’s word against yours. But that can’t happen with a cell phone. Why? Because your car doesn’t have a pass code and your cell phone does. So let me say it again: For the same reasons that you don’t have to answer a cop’s questions, under NO circumstances are you required to unlock or give the cops your cell phone’s pass code; and unless you’re foolish enough to give them access, if law enforcement wants to get into your cell phone then they’re gonna need to get a warrant.
