In Texas, what is generally referred to as DUI in other states (like California) is called DWI. DWI in Texas: Under Texas Penal Code 4904, "Driving While Intoxicated" (DWI) is the correct term. DWI offenses can be classified as Class B or A misdemeanors, or as felonies, depending on the circumstances. DUI Specific to Texas: Texas does have a DUI (Driving Under Influence) offense, but it specifically refers to a Class C ticket for minors under the age of 21. If an officer detects any alcohol smell on a minor driver, they can be charged with a DUI. This charge is not based on the minor being intoxicated, but merely on the presence of alcohol. Intoxication Standards for Minors: The same intoxication standards for DWI (a BAC of 0.08 or loss of normal mental or physical faculties) apply to minors. If a minor meets these criteria, they would be charged with a DWI, a more serious offense than DUI. Distinguishing DUI from DWI for Minors: If an officer smells alcohol on a minor but does not believe the minor is intoxicated to the standard of a DWI, the minor will be charged with a DUI, a less severe Class C ticket.
