Ct. 2484 (2019) Gerrymandering means drawing electoral districts according to ulterior motives. Partisan gerrymandering draws districts in favor of the political party in power. In Rucho versus Common Cause, two state legislatures adopted redistricting plans with clear intent to dilute one party’s vote. Voters who were disadvantaged by the plans headed to federal court. But will the federal judiciary enforce limits on partisan gerrymandering? State lawmakers in North Carolina, including Robert Rucho, created a districting plan enacted by the state legislature in Twenty Sixteen. The Republican-led effort drew a map intended to produce a majority of Republican congressmen. Elections held using the plan resulted in nine Republican and three Democratic winners. Separately, Maryland adopted a redistricting plan with Democrats at the helm. Desiring to flip a district to the Democratic Party, the lawmakers moved three hundred sixty thousand voters out of one district and three hundred fifty thousand new voters in. A Democratic congressman was later elected. Voters in both states challenged the districting plans in federal court. Both district courts ruled in favor of the voters.
