In Former Yugoslav Republic of Macedonia versus Greece, we’ll see whether Greece was permitted to suspend its treaty obligations just because it objected to another country’s name. In 1991, the Republic of Macedonia, referred to here as Macedonia, declared its independence from Yugoslavia. Greece objected to the use of the name Macedonia because, among other reasons, a region in Greece was also named Macedonia. Greece also objected to Macedonia’s flag design because it contained a Vergina sun, which Greece claimed is part of Greek history and culture. When Macedonia attempted to join the UN, Greece objected due to Macedonia’s name. However, in 1993, Macedonia was eventually admitted to the UN under the temporary name Former Yugoslav Republic of Macedonia. The following year, Greece imposed an embargo on Macedonia. In 1995, Greece and Macedonia entered into an interim accord to stabilize the relationship between the countries. Under the accord, Macedonia agreed to remove the Vergina sun from its flag. Greece agreed that it wouldn’t object to Macedonia’s future applications to join non-UN-affiliated international institutions as long as Macedonia used the name Former Yugoslav Republic of Macedonia. In 2008, Macedonia applied to join the North Atlantic Treaty Organization, or NATO, as the Former Yugoslav Republic of Macedonia. However, Greece objected due to Macedonia’s name, even though Macedonia was attempting to join under the name Greece had previously agreed to in the interim accord. NATO held that Macedonia wouldn’t receive an offer for membership until its name issue was resolved. Macedonia initiated proceedings against Greece at the International Court of Justice in 2008. Macedonia argued that Greece violated the interim accord by objecting to Macedonia’s NATO application. Greece argued that its actions weren’t objections and were only diplomatic correspondences that raised issues about Macedonia’s eligibility to join NATO. Greece also argued that Macedonia violated the accord because Macedonia continued using the Vergina sun symbol in other mediums. For example, a Macedonian army regiment used the symbol until 2004. Private citizens also used the symbol on billboards and other public displays. Because Greece argued that Macedonia breached the accord, Greece claimed it was justified in suspending its obligations under the accord pursuant to Article 60 of the 1969 Vienna Convention on the Law of Treaties. In response, Macedonia argued that Greece never alerted Macedonia to any of the alleged breaches and never sought to invoke its right of suspension under the Vienna Convention.
