Donor requirements – Only practicing Muslims for at least five years can dedicate land for waqf. Women’s inheritance rights are protected. 3. Government land – If mistakenly recorded as waqf, government land will no longer be considered waqf. The District Collector, not the Waqf Board, will have the final say in disputes. 4. Authority shift – Waqf Boards lose their power to declare and manage waqf land; this responsibility moves to state-appointed officials. 5. Waqf surveys – Now conducted under the District Collector, aligning with state revenue laws. 6. Council & Board changes – Non-Muslims can now be part of the Central Waqf Council and State Waqf Boards. At least two Muslim women must still be included. 7. Tribunal modifications – Removes the requirement for a Muslim law expert. The tribunal will now include a District Court judge and a state government joint secretary. 8. High Court access – Appeals against tribunal decisions can now be filed in the High Court within 90 days. 9. Central oversight – The central government gains authority over Waqf registration, audits, and accounts, replacing state control. 10. Sect-Based Waqf Boards – Shiite and Sunni Boards now extend to Bohra and Agakhani communities. 11. The Bill changes the composition of the Central Waqf Council and Waqf Boards to include non-Muslim members. 12. The Survey Commissioner has been replaced by the Collector, granting him powers to conduct surveys of waqf properties. 13. Government property identified as waqf will cease to be waqf. Collector will determine ownership of such properties. 14. Finality of the Tribunal’s decisions has been revoked. The Bill provides for direct appeal to the High Court. What is a Waqf Property? A Waqf is a property donated by Muslims for a specific religious, charitable, or private purpose. Ownership of the property is considered to belong to God, while its benefits are directed to the specified purposes. Establishment: A Waqf can be established through a written deed, legal instrument, or orally. Use and Permanence: A property may be recognised as Waqf if it has been used for religious or charitable purposes over an extended period. Irrevocability: Once a property is designated as waqf, it cannot be reclaimed or altered by the donor. However, not all Islamic countries have Waqf properties. Countries like Turkey, Libya, Egypt, Sudan, Lebanon, Syria, Jordan, Tunisia, and Iraq lack Waqfs. In contrast, India has Waqf Boards as the largest urban landowners, with legal protection under an Act. Waqf Boards in India oversee approximately 8.7 lakh properties covering around 9.4 lakh acres of land, with an estimated worth of ₹1.2 lakh crore.
