On July 12, 2021, at 1:31 AM, Miranda Paige Hinnant, age 19, was arrested by Officer Proffer of the University of Central Florida Police Department for Driving Under the Influence (DUI). The incident began when Sgt. Holt (UCF PD) pulled Miranda over after witnessing her swerve through the center divider nine separate times. During the traffic stop, Sgt. Holt also confiscated what appeared to be a fake ID from Miranda. Officer Proffer, a rookie at that time, was responding on scene with her field training officer guiding her through the procedure. She requested Miranda to perform field sobriety tests, including a test where Miranda was asked to pose as if she were “skiing,” which Miranda later expressed discomfort about, saying she was “scared”. Shortly thereafter, while she was in that vulnerable “ski position,” she was handcuffed and arrested. At the station, Miranda blew a 0.116 / 0.117 BAC on a breathalyzer test, over the legal limit. She was charged with DUI (driving under the influence). Additional details: Miranda agreed to a DUI Diversion Contract, which included 50 hours of community service, DUI school, a Victim Impact Class (MADD), a 10-day vehicle impound, a $500 donation to a non-profit, $180 fee to the department, and a stipulation that she must not consume any alcohol or attend any bars or clubs during the term of the contract. ⚖️ Did the officers act professionally?
