We are excited to introduce you to our very successful program called the Gap Customer Arbitration Program (GCAP). GCAP is designed to assist small to mid-sized Broker/Dealers and their Registered Representatives who are covered by professional liability (errors and omissions) insurance coverage, with legal defense in customer arbitrations related to transactions and services provided during the coverage period. In today’s competitive E&O insurance market, most firms carry per-claim deductibles of $100,000 or greater. GCAP covers the initial defense costs until the policy retention (deductible) per claim is satisfied.* This program can be a valuable addition to your risk management strategy, saving your firm from uncovered legal costs and ensuring that both the firm and your representatives receive the best possible defense. GCAP will protect your firm and its representatives by offering experienced securities arbitration counsel to provide expert legal defense and case strategy, managing costs, providing ongoing review and consultation, and engaging local counsel when necessary. It covers the deductible portion of E&O claims for a flat monthly fee and continues to provide representation under the E&O policy on an hourly basis once the deductible is satisfied. We work in tandem with your E&O provider to ensure seamless coverage for the legal defense of all covered FINRA arbitration cases. An appealing feature of the program is that there is no direct cost to the firm. Instead, the monthly fee is passed through to your registered representatives and deducted through payroll or other methods as you determine.
