By Order of the FDA All Vaping Products are now “Tobacco Products”. This includes but not limited to: Cotton, Wire, Batteries, Tanks, Mods, Atomizers, E-Liquid. Effective August 8th 2016: • No FREE Testing of E-Liquid. • No FREE Tobacco Products. • No RDA/RTA builds can be made by the staff. • No New Model/Upgrades of Products can be sold without PMTA Approval. • No Modifications, in any manner, of Vape Equipment can be made by the staff. • Upon Entering This Shop All Customers must be 18+ and must present a valid State/Federal photo ID. (No Children Allowed) The Food and Drug Administration (FDA) published long-awaited rules May 10th, 2016. Passed in 2009, the Tobacco Control Act says all e-cigarette products released after February 15, 2007, (predicate date) will have to go through the Pre-Market Tobacco Applications process (PMTA). Since almost all vapor products on the market were released after February 2007, hardly any will avoid a PMTA and almost no businesses, with the exception of big tobacco companies, will be able to bear the regulatory burden. The FDA’s new rules require businesses to register the products they manufacture (E-Liquid/Equipment) before August 8th, 2016. They must obtain a PMTA for each of their SKU (stock keeping unit) products separately in a lengthy process that could cost over $1 million per SKU no later than August 8th, 2018. If a business creates a new product (E-Liquid/Equipment) after August 8th, 2016 they must obtain a PMTA before the new product can be sold. Doing the math, five flavors of e-liquid, each with three different nicotine levels, could run in excess of $15 million, 5,000 man hours and two years, to clear the FDA process. As of August 8th 2018 99% of all Vape Shops will be closed.
