The Supreme Court of India has agreed to examine whether the Nucleic Acid Test should be made compulsory in blood banks across the country to ensure safer blood transfusions. A petition filed by an NGO argues that access to safe and infection-free blood is part of the Right to Life under Article 21 of the Constitution of India. The plea highlights that NAT is a more sensitive method than traditional screening techniques like Enzyme-Linked Immunosorbent Assay, as it detects viruses earlier and reduces the “window period”. NAT helps detect infections such as Human Immunodeficiency Virus, Hepatitis B, and Hepatitis C, making blood transfusions safer for patients who require regular transfusions, including those suffering from Thalassemia. However, the Court has also raised concerns about the financial feasibility of implementing NAT across all States. Currently, blood safety in India is regulated under the Drugs and Cosmetics Act, 1940 and overseen by the National Blood Transfusion Council. Recent reports of children allegedly contracting HIV due to contaminated blood transfusions in Madhya Pradesh and Jharkhand have intensified the debate over blood safety standards.
