This is a shortened and annotated clip of my recent discouraging experience attempting to place a written Kansas Open Records Act(KORA) request at the Wellington USD 353 and requesting a courtesy signature validating that the office had received it, as I have received previously when hand-delivering written KORA requests to this same office. Though I will say that when they were speaking with me, everyone was mostly cordial and polite, there was no knowledge or education offered on KORA in general or their proper procedures... they just simply gave me back my written request(No request shall be returned... because of any technicality) and walked away saying they would call the superintendent again and the cops were called while I was left to wait in the lobby unattended!! They are supposed to have a brochure available to offer the public explaining the basics of KORA and their specific procedures and/or have their procedures prominently displayed for public observation. 45-220 Procedures for obtaining access to or copies of records... https://ksrevisor.gov/statutes/chapte... 45-226 Local freedom of information officer. https://ksrevisor.gov/statutes/chapte... 45-227 Brochure concerning public records. https://ksrevisor.gov/statutes/chapte... The Police report says that they were told that I had refused to leave but I was never asked to leave. I cannot be trespassed from a publicly accessible area of a public building where I have business to conduct without there being a crime committed anyhow. Though my tone started to express a bit of irritation that no one there knew or offered a proper procedure for KORA requests, I believe I conducted myself in an acceptably cordial and professional manner throughout the interaction. I do have a naturally loud voice but that is apparent at the beginning of the encounter when I first enter the building. I have Tourette syndrome and other neurological issues involving complex vocal tics causing me to stutter, repeat my words, repeat other peoples words, and get frustrated at my own vocal situation and not the interaction itself, so sometimes I come off a bit rough around the edges. I only became verbally demanding and assertive when they tried to give the request back to me but I was not attempting to be "intimidating" as described in their conversations with the superintendent that was not in this office that day. I made no aggressive gestures or insinuations that I was a danger to anyone. I am quite upset and discouraged at this treatment of the public when attempting to gather data at that data gathering place! While not legally required by the Kansas Open Records Act (KORA), it is a common and recommended practice for requesters to get some form of signed or written confirmation of receipt when delivering a KORA request in person. This documentation helps establish proof of delivery and the exact date and time the agency received the request, which is crucial because the agency's three-business-day response window begins upon receipt. When submitting a request in person, a requester can bring two copies of the written request and ask the agency's open records officer (or designated recipient) to stamp and/or sign the second copy as a receipt, which the requester then keeps for their records. This provides concrete proof of submission. I cannot believe I was treated this way for rebuking their attempt dismiss and delay my concerns and request and that they did not know how to handle a public records request! Please excuse my poor videography. PS: I AM NOT A CONSTITUTION AUDITOR... I am a member of this community expecting accountability and transparency in my own local government agencies!!!
