Equestrian Girl Arrested for DWI at Over DOUBLE the Limit

Around 12:14 AM on August 3, 2023, Sergeant Thomas Hayes with the Point Pleasant Beach Police Department observed a passenger inside a red 2022 Jeep yelling out the window in the area of Ocean Avenue and Elizabeth Avenue. He began following the vehicle and he observed the driver swerving before making a turn without properly signaling. He continued to follow the vehicle and initiated a traffic stop in front of Spicy’s Taco & Tequila Bar (1506 Route 35 North). He made contact with the driver from the passenger side, and she was later identified as 26-year-old Carly. As he was speaking with Carly, Sergeant Hayes detected the odor of alcohol and observed other indicators of impairment. After additional officers arrived on scene to assist, Carly was asked to exit the vehicle and perform field sobriety exercises. The first exercise was the recitation of the alphabet from “A” to “Z.” The second exercise was the One Leg Stand test. During the One Leg Stand test, Carly failed to raise her foot in the proper fashion and put her foot down before the test was complete. The third exercise was the Walk and Turn test. During the Walk and Turn test, Carly did not touch heel-to-toe on each step, turned improperly, and took and incorrect number of steps. The final exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Sergeant Hayes observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. Based on her erratic driving, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, Sergeant Hayes placed Carly under arrest for driving under the influence. Carly’s vehicle was impounded for a 12-hour hold according to John’s Law. Officer Biondi transported Carly back to the Point Pleasant Beach Police Department for further processing. Carly was read the Standard Statement for Motor Vehicle Operators at the station, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.17%, which was more than double the legal limit of 0.08%. After the officers finished processing her, she was released to her parents pending her court appearance after her father signed the Potential Liability Warning form on Carly’s behalf. Sergeant Hayes issued Carly the following citations: -Operating under the influence -Reckless driving -Traffic on marked lanes -Failure to give proper signal Court records indicate that on February 27, 2024, Carly pleaded guilty to operating under the influence. As a result of her guilty plea, Carly was sentenced to a license revocation of 3 months, 12 hours at an intoxicated driver resource center, and 2 days in jail. She also had to pay a total of $640 in fines. North Jersey Media Group, 993 A.2d 778 (2010) that “The fair-report privilege reflects the judgment that the need, in a self-governing society, for free-flowing information about matters of public interest outweighs concerns over the uncompensated injury to a person's reputation.” This video advances a compelling public interest. The summary of events was based on records that are “open to public view through open access to public records” as defined in the Salzano case. In Ramos v. Flowers, 429 N.J. Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
