What are the different degrees of Murder in Pennsylvania? There is 1st Degree Murder, which is a premeditated killing. 1st degree Murder in Pennsylvania is life in prison if convicted. 2nd degree Murder in Pennsylvania is a killing in the commission of a felony. 2nd degree Murder in Pennsylvania, if convicted is also life in prison. 3rd degree Murder in Pennsylvania is any other murder that's not 1st or 2nd, and requires an element of malicious forethought or extremely reckless behavior. (0:10) We’re going to talk about the topic of what murder in the first, murder in the second, and murder in the third degree is in Pennsylvania. (0:20) Okay. This is about Pennsylvania law only, okay? Let’s talk about what murder in the first degree is. Everyone knows what murder in the first degree is in Pennsylvania. (0:30) This is what every book, movie, TV show. These are the things that we watch in the movies or the crime shows. We all like the crime shows, okay? And if you’re tuning into this video, you probably do watch those crime shows. (0:40) Murder in the first degree, that’s the person that’s premeditating. That person is planning, that person is plotting or hiring someone. (0:50) That is murder in the first degree. In Pennsylvania, murder in the first degree, if you’re convicted of that, life in prison without parole. And Pennsylvania, when Pennsylvania says life, (0:60) it means life. It means no parole. Other states, it could mean 25 years, it could mean after 50 years, it could mean basically you can get parole at some point. (1:10) But Pennsylvania, parole, life without parole, no coming home. You’ve died in prison. Now, let’s talk about murder in the second degree. Very easy. It also is life without parole, but what this means is that (1:20) in the commission of a felony, someone died. For instance, someone is robbing a store, robbing a bank, committing some other kind of felony. In my example, they’re committing (1:30) robbery, okay? And if during the course of that robbery, someone dies, that’s murder in the second degree. Murder in the second degree, also life without parole. No coming home. Once again, (1:40) Pennsylvania, life without parole means life without parole. Let’s talk about third degree. Third degree is any other murder that’s not first or second degree. (1:50) And basically, what it means is it’s kind of a reckless act. It’s being and acting in a way where you’ve caused the death of someone else, but you didn’t do it premeditated (2:00) and you didn’t do it when committing a felony. It’s basically somewhat reckless behavior, malicious, just not caring. It’s acting in a way where you’ve caused the death of someone because of your actions, (2:10) but you didn’t plan to kill someone. Let me give you an example. Let’s say a person is driving 100 miles per hour down a street and the speed limit is 15 miles per hour. (2:20) They crash and kill someone. That could be third degree murder. Say someone is shooting a gun off in the air on New Year’s Eve, shooting a gun off, malicious, not paying attention, not caring, (2:30) having a bunch of beers and shooting a gun off in the air.
