Cross-examination of the Investigation Officer (IO) in a criminal case is one of the most important parts of trial. The defence lawyer usually tries to highlight defects, contradictions, and illegalities in the investigation to create doubt in the prosecution story. Here are important points/questions that are commonly asked in cross-examination of an IO (especially in cases like narcotics, murder, theft, etc.): --- 🔹 General Questions on Role & Duty 1. When were you appointed as IO in this case? 2. Did you make the daily diary entry (roznamcha) regarding your departure and arrival? 3. Did you record statements of all witnesses under section 161 Cr.P.C.? 4. Did you reduce those statements into writing at the spot or later? 5. Did you read over the statements to the witnesses after recording? --- 🔹 Recovery & Seizure (if applicable) 6. At what exact place and time was the accused arrested? 7. Were there independent witnesses available at the time of recovery/arrest? 8. Did you try to associate any private witness in recovery proceedings? If not, why? 9. Did you seal the recovered property at the spot? With which seal? 10. Where is that seal now? Did you deposit it in malkhana? 11. Who kept the case property in safe custody? --- 🔹 Documentation & Evidence Collection 12. Did you prepare site plan (naksha-e-waqiat)? On whose pointing? 13. Did you send the recovered material to the Forensic Science Laboratory? On what date? 14. Did you personally deliver it, or through a constable? 15. Do you have acknowledgment receipt from FSL/Malkhana? 16. Is there any tampering possibility as you didn’t seal it properly? --- 🔹 Contradictions & Omissions 17. Did you record all facts in your case diary? If not, why? 18. Witnesses have stated differently in court—did you confront them at that time? 19. Why is there delay in lodging FIR / sending recovery to laboratory? 20. You did not verify accused’s presence at the scene independently, correct? --- 🔹 Neutrality & Fairness 21. Did you investigate the defence version / alibi of accused? 22. Did you make any effort to find independent corroboration? 23. Did you only rely upon complainant’s version? 24. Did you record statements of persons favorable to accused? 25. Can you show in record that investigation was impartial? --- ✅ Purpose of cross-examination on IO: To show defective investigation (no independent witnesses, late sending of samples, tampering chances, missing entries). To prove bias or unfairness of IO. To create benefit of doubt for accused.
