Reed | 404 U.S. 71 (1971) After the Civil War, the war-torn nation adopted the Fourteenth Amendment, including its Equal Protection Clause, with the primary purpose of protecting the rights of formerly enslaved African Americans. Yet the language of the clause generally speaks of quote, “persons,” unquote, and on its face thus isn’t limited to prohibiting racial discrimination. Does the clause’s general language protect people from being discriminated against based on their gender as well as based on their race? The United States Supreme Court first addressed this issue in Reed versus Reed. After Sally and Cecil Reed divorced, their minor son, Richard, committed suicide. Richard didn’t have a will, so Sally petitioned the state’s probate court to be appointed as the administrator of his estate. Cecil then filed a competing petition to be appointed as the administrator. Based on an Idaho probate statute that required a male petitioner to be appointed over a female petitioner if the two were otherwise similarly situated, as Sally and Cecil were, the trial court appointed Cecil. Sally appealed to the state’s district court, contending that the statute’s gender preference violated the Equal Protection Clause. The district court agreed and held that the statute was unconstitutional. On Cecil’s further appeal, the Idaho Supreme Court reversed the district court’s judgment after concluding that the statute’s gender preference reasonably promoted efficient probate administration by eliminating litigation about who should be appointed administrator when competing petitions have been filed.
