The government does not pursue asset seizure randomly. There is a calculation behind every decision, and understanding it could be the difference between protecting what you have built and losing it entirely. Federal attorneys and agency investigators have significant discretion when it comes to deciding which tools to deploy in an investigation. When it comes to asset seizure specifically, several factors carry serious weight. The size of the alleged fraud matters. The amount of federal dollars at risk matters. Foreign ties matter. If a subject of an investigation has family members, business connections, or financial interests outside the United States, the government may view that as a direct risk that money could be moved beyond their reach. Most critically, if the government believes that waiting through the full investigation and charging process creates a real risk that assets will be dissipated or disappear, they will move to lock those assets down at the very beginning. They are not going to wait for the process to play out if they think the money will be gone by the time it does.
