During oral arguments on Wednesday in a case that will determine the future of President Donald Trump's economic agenda, most of the justices–including some appointed by Republican presidents–sounded skeptical of the Trump administration's answers to the core question of the case: with his sweeping tariffs, has Trump overstepped his executive authority by imposing taxes on imports? Trump turned to the 1977 International Emergency Economic Powers Act to unilaterally impose tariffs on virtually every country on earth, even though the Constitution gives Congress the authority to tax, not the president. Trump asserts tariffs address two emergencies: the fentanyl crisis and trade deficits. IEEPA has never been used by a president in this way and the statute does not mention tariffs.
