Conduct often betrays the truth. 🔹 Documentary Proof Layer – A witness may claim many things, but documents like FIR, MLC, site plan, seizure memo, and arrest memo often speak differently. By confronting the witness with these documents, you expose omissions and contradictions. Law gives this weapon under Sec. 181 BNSS (Sec. 162 CrPC, old) and Sec. 348 BNSS (Sec. 311 CrPC, old). 🔹 Motive Layer – Ask: why is the witness testifying? Does he have a personal grudge, political rivalry, or police influence? Sometimes, the motive explains the entire false testimony. 🔹 Contradictions Layer – This is the sharpest sword. By pointing out inconsistencies between FIR, 161 statement, 164 statement, and court testimony, you bring the entire case down. 🔹 Legal Infirmities Layer – Finally, highlight the broader gaps: lack of medical support, defective Test Identification Parade (TIP), missing chain-of-custody, and procedural violations.
