The Varanasi district court on Friday ordered an extensive survey of the disputed Gyanvapi Mosque by the Archaeological Survey of India or ASI to find out whether the mosque was built over a pre-existing Hindu temple. According to the court’s order, the director of ASI is directed to conduct a detailed scientific investigation of the Gyanvapi Mosque by using dating method, GRP survey, excavation and other modern techniques to find out if the mosque structure is built over a hindu temple. The court seeks a report from ASI by August 4, and after it, the matter will be taken up. Well, now let's go back in time and dive into the history of the mosque. But, before diving into Gyanvapi Mosque history, let's get to know when the dispute over the mosque began. The first religious parliament was held in 1984, where the Hindu seers issued a resolution to lay claims on three Hindu shrines where mosques had allegedly been built, one was in Ayodhya, next in the list was Mathura and last one was in Varanasi. Rajya Sabha in 1991, passed the Places of Worship Act, which prevents the conversion of a place of worship from the form it took from August 15th, 1947. This legislation sought to prevent future tussles over the identity of religious sites, but the legislation made an exception for the Babri Masjid and Ayodhya dispute. The BJP at that time opposed the 1991 bill but it welcomed the Ayodhya exception. BJP requested that the exception be extended to Krishna Janmabhoomi Dispute in Mathura and to the Kashi Vishwanath dispute in Varanasi, that is about Gyanvapi Mosque. But, this exception was never granted. The first petition surrounding the Gyanvapi Mosque entered the court of law in 1991. A priest from Varanasi filed a petition at Varanasi Court alleging that it was built over a pre-existing Kashi Vishwanath Temple and requested the access to pray within the Gyanvapi Mosque. The petition also sought transfer of mosque land to Hindus. The whole matter lay dormant until 2019. Barely a month after the Ayodhya verdict in 2019, a fresh petition was filed at Varanasi Court seeking an archaeological survey of the Gyanvapi Mosque for the assessment of the mosque's origins. According to reports, the petitioner appeared as a next friend of the deity of Kashi Vishwanath. Also, the 1991 plaintiffs approached the Varanasi court to hear the original petition again. The proceedings were stayed by the Allahabad High Court in February 2020. Despite the stay , the matter was reopened at Varanasi court in April 2021. The court ordered an archaeological survey into the mosque’s origin. The mosque management approached the Allahabad High Court, which again stayed the proceedings in September 2021. The case reached the Supreme Court in October 2020, when a Writ Petition was filed challenging the constitutionality of Section 2,3 and 4 of the Places of Worship Act. However, the case remained pending before the Court. Later in August 2021, five Hindu women filed a petition at a Varanasi Court seeking permission to worship within the Gyanvapi mosque. With the recent orders , ASI has to carry out GPR surveys under three domes of the mosque and beneath the western walls. The court further directed to perform excavation if required.
