Arkansas | 514 U.S. 927 (1995) At the time that the United States adopted the Fourth Amendment in 1791, the Anglo-American common law of search and seizure recognized law enforcement officers’ authority to break open a person’s door when executing a warrant, but generally required that officers first knock and announce their authority. But is this knock-and-announce rule a constitutional requirement under the Fourth Amendment? The United States Supreme Court addressed this issue in Wilson versus Arkansas. In 1992, Sharlene Wilson sold illegal drugs to an undercover police informant. After several sales, officers applied for and obtained warrants to search Wilson’s home and arrest her. Officers then went to Wilson’s home, where they found the front door open with only a closed but unlocked screen door securing the entrance. Without knocking and announcing their authority, the officers opened the screen door and entered the residence, identifying themselves as police officers and announcing that they had warrants only as they entered. Once inside, the officers seized various types of drugs as well as a firearm. They encountered Wilson in the bathroom as she was flushing drugs down the toilet. After the officers arrested her, she was charged with various drug-related offenses. Wilson filed a motion to suppress the evidence seized from her home, contending that the officers had violated the Fourth Amendment by failing to knock and announce their authority before entering her home. The trial court denied the motion. A jury convicted Wilson, who was sentenced to prison. On appeal, the Arkansas Supreme Court affirmed her conviction.
