An easement is a right that one person has over the land of another person, for the beneficial enjoyment of their own land. There are many different types of easements, but some of the most common include: Right of way: This is the right to cross another person's land in order to access your own land. Right to light: This is the right to receive unobstructed sunlight onto your land. Right to water: This is the right to use water from another person's land for your own purposes. Easement rights can be acquired in a number of ways, including by grant, prescription, or necessity. Grant occurs when the owner of the servient land (the land that is subject to the easement) gives the dominant owner (the person who has the easement) the right to use their land in a particular way. Prescription occurs when the dominant owner has been using the servient land for a certain period of time (usually 20 years) without the servient owner's permission. Necessity occurs when the dominant owner needs to use the servient land in order to have reasonable access to their own land. Once an easement right has been acquired, it is generally considered to be a permanent right. However, there are some exceptions to this rule. For example, if the dominant owner no longer needs the easement, or if the servient owner's land is significantly damaged by the easement, the easement may be extinguished.
