By Grevazio Zulu The South African High Court in Pretoria has reserved judgment in a case brought by the family of former Zambian President Edgar Lungu, who is seeking leave to appeal a ruling concerning the burial of Zambia’s sixth President. This follows submissions from legal representatives of both the family and the Zambian government. The family is challenging a High Court judgment that affirmed the Zambian government's right to repatriate the late President’s body for a state funeral and burial at Embassy Park in Lusaka. Advocate Tembeka Ngcukaitobi of Duma Nokwe Chambers, representing the family, argued that the appeal has a reasonable prospect of success, noting that the Supreme Court may reach a different conclusion. He further submitted that South African law should have been applied in the original decision, rather than foreign law. However, Advocate Ben Stoop of Brooklyn Advocates Chambers, representing the Zambian government, contended that the application should be dismissed, stating that the court had correctly interpreted the existence of a contract between the government and the family. He maintained that the state was within its rights to repatriate the body. Stoop also argued that even if Zambian law were not applicable, the outcome would remain unchanged, as public interest would override private interests in such matters. #EdgarLungu
