Austin Criminal Defense Attorney Charlie Roadman explains the criminal court process in Texas and the roles of the key players: the judge, the prosecutor, and the defense attorney. The judge is responsible for overseeing the defendant's bond and court appearances and also has the authority to approve or reject plea bargains offered by the prosecutor. While judges do not create plea bargains, they play a crucial role in finalizing them. If a plea bargain is not accepted, the judge oversees the trial. The prosecutor's role involves reviewing and gathering evidence, including watching videos and reading police reports. They negotiate with the defense attorney to reach a compromise, which can be a lengthy process. The prosecutor decides on the plea bargain to offer, and if it's not accepted, they represent the government in the trial, aiming to convict the defendant. The defense attorney negotiates with the prosecutor, aiming to either dismiss the case or minimize the punishment. They advise the defendant on whether to accept the plea bargain. The defense attorney's responsibilities also include handling dismissal paperwork or pleas, ensuring the accuracy of documents and the protection of the defendant's rights. In cases where a plea bargain is not reached, the defense attorney represents the client in a jury trial.
