In Frosty Treats versus Sony Computer Entertainment, we explore the boundaries of trademark protection. Frosty Treats Incorporated owned and operated a national fleet of ice cream trucks. The company's name, Frosty Treats, appeared on a small decal near the rear of the trucks in pink capital letters. The trucks also displayed a safety clown in two locations. The safety clown was a clown image surrounded by text directing customers to cross at the rear of the vehicle to minimize potential traffic accidents. In the mid nineteen nineties, Sony Computer Entertainment America released Twisted Metal two, a video game that allowed players to cause mayhem on virtual streets using a variety of vehicles. One of the characters, a crazed clown, drove an ice cream truck bearing the words, Frosty Treats. Frosty Treats sued Sony for trademark infringement, alleging that Sony's ice cream truck design and clown character created a likelihood of confusion as to Frosty Treats affiliation with the games. Sony filed for summary judgment. The district court granted the motion, holding that neither the phrase frosty treats nor the safety clown image were entitled to trademark protection and that there was no likelihood of confusion between the game and Frosty Treats trade dress.
