SC Ruling: "5 Out, 2 In" in Delhi Riots Larger Conspiracy Case | Split Verdict: Supreme Court Grants Bail to 5 Activists; Rejects Pleas of Umar Khalid and Sharjeel Imam | In a major judicial update today, January 5, 2026, the Supreme Court of India delivered its long-awaited verdict on the bail pleas of several activists accused in the 2020 Northeast Delhi Riots "Larger Conspiracy" case. A bench comprising Justices Aravind Kumar and NV Anjaria provided relief to five individuals who have been in custody for over five years, while denying liberty to former JNU student leader Umar Khalid and activist Sharjeel Imam. The court noted that while prolonged incarceration is a concern, the gravity of allegations involving national security and the integrity of the state cannot be ignored. The bench established a "hierarchy of culpability," ruling that Khalid and Imam played "central and formative roles" in the planning and mobilization of the violence. Consequently, the court found that the statutory bar under Section 43D(5) of the UAPA remains applicable to them.
