Many of us have felt cheated by our healthcare providers at some point in our life. It can be financial, or in terms of quality of treatment. And although, information is available at our fingertips today, when it comes to fighting against medical negligence, we are always at a loss. This video attempts to provide at least some preliminary guidance for going about this situation. Here are four different legal options of seeking justice from a negligent healthcare professional, hospital, or agency. There are two ways in which you can be wronged by a doctor. Civil wrong and Criminal Wrong. The lines between these two categories are a little blurry, but broadly, Civil Wrong means anything that a doctor does without any actual criminal intention. Anything from an error of judgment in the treatment, shoddy surgical work, etc can come under civil wrong. Criminal wrong is anything that is done with criminal or malicious intent. Although just because something is done without criminal intent, gross negligence can still be considered criminal. If there is a civil injustice, you have the option of seeking justice in form of compensation, either in the civil court, or the consumer court. But If you think you have been the victim of a criminal wrong, you can also file an FIR against the doctor/hospital in your local police station at the same time. For filing a consumer complaint, go to the National Consumer Helpline and follow the instructions given on their home page. https://consumerhelpline.gov.in/ If you want to request for medical license revocation of the doctor, you could also go to the website of your respective state medical council. You can either use the email id or phone number provided on this page, to contact the authorities directly, or look for the Grievances section at the bottom. It will lead you to the Public Grievances portal of the government. https://pgportal.gov.in/ Please note, you will have to lodge your complaint on the website as this portal does not entertain complaints made via email. For filing a complaint with the human rights commission, go to https://hrcnet.nic.in/HRCNet/public/H... And click on the ‘Lodge Complaint’ tab. Provide all the information requested in the instructions panel. You will also be asked to submit any relevant documents in .pdf format.
