General Motors Corp., 373 U.S. 734 (1963) A union security agreement requires an employer to impose certain conditions on employment to protect the union’s interests. For example, in a closed shop, the employer may hire only existing union members. In a union shop, employees must join the union within a certain time. In an agency shop, employees must pay union dues and fees but need not actually join the union. In National Labor Relations Board versus General Motors, the Supreme Court discussed the legality of these types of agreements. The contract between General Motors and the union representing its national workforce provided for a union shop, meaning all employees had to join the union after 30 days of employment. These provisions didn’t apply in states with right-to-work laws that prohibited conditioning employment on union membership. An Indiana appellate court held that an agency-shop arrangement wouldn’t violate that state’s right-to-work law. Thereafter, the union proposed to General Motors that the parties negotiate the inclusion of a similar provision covering Indiana plants in their contract. Under this provision, continued employment at Indiana plants would be conditioned on paying the union amounts equal to the initiation fee and regular monthly dues paid by union members. Actual membership would be available to all employees but not mandatory. General Motors declined to negotiate, asserting that such an agreement would violate the National Labor Relations Act. The union filed charges against General Motors with the National Labor Relations Board, alleging that the company violated its statutory duty to bargain in good faith. The board ruled for the union. General Motors petitioned the Sixth Circuit for review. That court reversed. The United States Supreme Court granted cert. Want more details on this case?
