If you are denied after the video/phone or Live Hearing -Social Security Disability SSDI / SSI Administrative Hearing Level and receive an unfavorable decision from the ALJ, you can appeal this decision to the Appeals Council. This is the time that you can add new evidence and you can go back to your doctor for him or her to clarify the medical restrictions and to directly address the criticism of the law judge. Typically you have 60 days to get this new, material, related and relevant medical information filed with the Appeals Council. You can ask for an extension of time and they usually a grant this. Currently I recommend you faxing the information into the Appeals Council in Falls Church Virginia, Www.skipritchielaw.com 540-421-7003. If you are denied by the Appeals Council, you may appeal to Federal Court. I have helped claimants appeal from the Social Security Administration to Federal Court. The best result is when you are granted disability benefits referred to as a Sentence Four Reversal without a remand for a new hearing. Basically, the federal judge or magistrate recommends that you be found disabled and your benefits are granted and the decision below is reversed. I have appealed cases before the U.S. Federal Court of Virginia - Western District and U.S. Federal Court of West Virginia - Northern District. I have had success in the past and the court has granted our motion for summary judgment and the claimant wins benefits including back benefits.
