With the Nazis comfortably the largest party in the Reichstag, Hitler, at the recommendation of prior chancellor Franz von Papen, is appointed chancellor of Germany by President Paul Von Hindenburg. Despite this, Hitler would still have his quest for power restrained by a coalition, elected via the democratic process. As such, the Nazis would have to work within the parameters of a non-majority, a result of communist gains in the years prior 1932 election. Thus, it would require a rather dubious stroke of luck for Hitler to unshackle himself from a system limiting his fascist goals. Such luck would strike on the night of February 27th, 1933, exactly 4 weeks after Hitler had been sworn in as Chancellor. On this cold evening democracy would burn with the Reichstag, home of the German Parliament. Reported shortly after 9pm, the building would be engulfed in flames, with utter devastation done to the Chamber of Deputies. As firefighters began to put out the fire, Hitler, Goebbels, and Goring would all arrive by car. Outraged, severe political repercussions followed. A communist activist named Marinus van der Lubbe would be held accountable, the Dutch youth arrested and later decapitated for the arson attack. Though we will never know if he acted alone, with many historians believing Nazis conspiracy was at play, the immediate outcome of the fire saw the passing of the Reichstag Fire Decree. At the request of Hitler, this required President Hindenburg to authorise article 48 of the Weimar Constitution . As a result most civil liberties were suspended, including freedom of expression, freedom of press, and the right of free association and assembly. Of specific importance, the decree saw the suspension of Habeas Corpus, the right to appeal wrongful conviction. With this barrier to illegal arrest now gone, masses of communists and opposition were rounded up. With Hitler now in complete control of emergency powers, the Nazis would manipulate the burning of the Reichstag to cause panic amongst the public. This fabricated propaganda would lead many to buy-into the Nazi rhetoric of an impending communist takeover. As a result the Nazis would achieve their greatest election victory on March 5th, a mere 7 days after the Reichstag fire. Indeed, by having the communist party suppressed, the Nazis would decidedly increase their share of the vote from 33% to 44%. Consequently, Hitler would finally achieve his majority government alongside his allies, holding 52% of parliament. In the weeks following the Enabling Act would come to pass, allowing Hitler to enforce laws without the Reichstag. The Nazis were now fully immune to the checks and balances of government, even when violating individual rights prescribed in the constitution. Dictatorship inevitable, the Nazi Party was declared the only legal political party in Germany on July 14th, 1933. Hitler was now the most powerful man in Germany, his rule absolute. However, Hitler's life had not always been one of power. He had started adulthood as an often homeless artist.
