A good portion of this was not captured on video due to the camera having low battery and being on the charger. The official incident report is too long to add so a summary is below. He is innocent until proven guilty. He was charged with trespassing and resisting arrest. He was also given 2 citations. "On February 12, 2023, at approximately 1456 hours, I, Officer Joshua Beck of the Florida Fish and Wildlife Conservation Commission (FWC) responded to a call located at the Sebastian Inlet State Park, South side camp site #57, Indian River County, reference a subject yelling at park patron’s that he was going to kill them, run them over, end there lives, and cut there heads off. The park staff said the subject was refusing to listen to them and refusing to leave the park. The subject was told by the park staff manager on duty that he is trespassed for the day and needs to pack up his truck and camper. He was no longer allowed to camp inside the state park and needs to leave immediately. I remained at camp site #57 where the subject was located to ensure he packed his things and to escort him out of the park. The subject appeared to be packing then unpacking the same items over and over, intentionally delaying his time in the park. I told the subject he had been packing for over an hour and if he was not on his way out of the park in 15 minutes I would trespass him for the term of one year, write him for his dog being off leash, and for failing to listen to park staff. The subject told me to go ahead and start writing the tickets and the trespass. I contacted the SISP manager telling him the situation and he told me to trespass the subject for one year. At approximately 1712 hours, the subject had been issued two citations for failure to listen to park staff and dog off leash. The subject had also received a trespass notice for the term of one year. The subject then began leaving the state park but then stopped at the camper sewage pump out site. I told the subject he cannot dump his sewage he needs to leave the state park immediately. The subject was on the phone with 911 dispatch telling them he was not going to leave the park and that he felt his life was in danger. I told the subject I do not understand what you do not understand about you are trespassed and need to leave immediately. The subject continued to refuse verbal commands, I told the subject this is enough and to turn around to be placed under arrest for trespassing. The subject then began tensing and fighting with me refusing to listen to verbal commands and place his hands behind his back. I used a controlled arm bar take down to get the subject to the ground where I continued to yell loud commands to stop fighting and place his hands behind his back. The subject continued to brace and pull refusing to listen. I pulled out my agency issued OC spray (pepper spray) upon seeing this the subject complied by rolling on his stomach and placing his hands behind his back. The subject was placed under arrest at approximately 1727 hours and transported to Indian River County jail by Indian River County Sheriff’s department without incident.
