Supported living tenancies and the law with Sue Baxter

In this episode Sue Baxter talks about Supported Housing and the Law, she discusses licence and tenancy agreements. Sue argues that current occupancy agreements are not a good fit for many supported housing tenants and share considerations providers need to think about when setting up tenancy arrangements in supported living. Sue Baxter is a leading housing professional with over 30 years’ experience in the supported and social housing sector. Her experience ranges from managing specialist provision including domestic abuse and complex needs to working for large Registered Providers. Currently she works for L'Arche a National Learning Disability Charity alongside providing training and consultancy for housing associations, local authorities and voluntary organisations. Sue is an advocate for customer voice most recently working alongside ‘experts by experience’ producing European-wide housing and support training materials. Common example is where an organisation provides housing and support to young vulnerable people where you would need to check on their wellbeing any time of the night or day. Where there are separate organisations providing the support/care and housing it is commonly a tenancy, as it is not the landlord but the support/care provider needing to access the property and as it is a tenancy this is by invitation of the person. Also, I wanted to say that if a person lacks capacity to sign a tenancy agreement the only people who can sign on their behalf are those with a lasting power of attorney or who are (Court of Protection appointed) deputies for property and financial affairs. Where there isn't anyone with the authority to sign a single application can be made to the Court of Protection. As this takes time, most providers accept that the person will be living at the property on an unsigned agreement until the application is approved. My experience has been that Housing Benefit Departments accept an unsigned tenancy agreement along with a copy of the application to Court of Protection when a claim is made."
