In our previous lessons, we have covered Chapter 1 of the Civil Code. We learned about when laws take effect and the importance of the publication requirement. We also learned about how to compute legal periods and what impact they may have in other facets of the law. We also learned about the principles of territoriality, the nationality principle and the rest of the Conflict of Law provisions of the Civil Code. Today, we are opening a whole new chapter of the Civil Code. Today, we are starting with the Chapter on Human Relations. This Chapter, kapatid, runs from Article 19 to Article 36 of the Civil Code. Many of the concepts here are glossed over, dinadaanan lang during your first semester of your first year. This is because some professor think these are not bar matters except for Articles 19, 20 and 21 – which you will see again in Torts and Damages, and Article 36 of the Civil Code which contains the discussion on the Prejudicial Question. Today, we will begin with a discussion on the Chapter on Human Relations. Why do we have a Chapter on Human Relations? Bakit ba merong ganito sa Persons? Yan ang tanong sa amin ng professor namin, na two times lang nagpakita bago mid-terms. Pinalabas niya sa klase lahat ng di makasagot. The Chapter on Human Relations exists to prescribe the norm of conduct, or the things we have to observe, to comply with and to abide by, when we deal with other human beings. This chapter tells us about the limits of our rights, the specific causes of action or bases for legal action and the remedies for the violation of our rights.
