Structure Plan Provisions (Sections 42H to 42O) A. Definition and Purpose Definition: A "Structure plan" is a plan for the development of regional or town-level roads and regional or town-level public amenities within any Region, Planning Authority, or New Town Development Authority area. It requires State Government approval and includes revisions. B. Contents of a Structure Plan (Section 42J) A Structure Plan comprehensively covers various elements crucial for regional and town-level infrastructure: Transport and Communications:Roads, classified roads, railways, waterways, canals, and airports. Their extension and development. Road Infrastructure (Other than Classified Roads) with Minimum Widths:Nagar Panchayats and Non-Municipal Towns: minimum 9 meters and above. 'B' and 'C' Class Municipal Councils: minimum 12 meters and above. 'A' Class Municipal Councils and 'D' Class Municipal Corporation: minimum 15 meters and above. All other Planning Authorities, New Town Development Authorities, or any Region: minimum 18 meters and above. .Regional or Town Level Mobility Plan: Focuses on inter and intra-city connectivity. .Regional or Town Level Amenities: Includes essential public utilities and services .Preservation, Conservation, and Development: Of areas of natural endowment and landscape. .Regional or Town Level Parks. .Other Regional or Town Level Public Amenities: As approved by the State Government. .Considerations for Formulation: The Town Planning Officer (TPO) considers the interaction of the area with outside areas (National/State highways, district roads, railways, waterways, airports) and regional/town-level geographic features (lakes, rivers, nallahs, hills, forest areas). C. Process of Structure Plan Formulation and Sanction The process is structured and time-bound, involving multiple stages and public participation: .Declaration of Intention to Prepare (Section 42H): Who Declares: The State Government, by notification in the Official Gazette. Purpose: To undertake a Structure plan for a specified area. Initiation: Suo-moto (on its own) or upon proposal from a Planning Authority, New Town Development Authority, other statutory authority, or a Central/State Government agency. Public Notice: Notice published in the Official Gazette and local newspapers. Information Dissemination: Copy of notice and boundary plan dispatched to concerned District Collector, Planning Authority, or New Town Development Authority. Public Inspection: Boundary plan available for public inspection. .Appointment of Town Planning Officer (TPO) (Section 42I): Who Appoints: State Government. When: At the time of declaring intention. Rank: Not below the rank of Deputy Director of Town Planning. Role: Formulates the proposal for the Structure plan. .Preparation and Publication of Draft Structure Plan (Section 42K): Who Prepares: Town Planning Officer. Timeline: Within six months from notice of intention (extendable by three months). Public Notice: TPO publishes notice in Official Gazette inviting objections and suggestions. Public Participation: Objections/suggestions invited within thirty days. Plan available for public inspection and sale (maps, charts, report). .Objections to Draft Structure Plan (Section 42L): Submission: Any person can submit written suggestions/objections to the TPO within the stipulated time. Forwarding: TPO forwards these to the Planning Committee. .Planning Committee (Sections 42L, 42M): Appointment: Director of Town Planning, Maharashtra State, appoints within fifteen days of draft plan notice. Composition: Divisional Joint Director of Town Planning and Valuation Department; District Collector/nominated officer OR Administrative Head of Planning Authority/nominated officer; up to two experts. Inquiry and Hearing: Conducts inquiries and provides hearings to those who filed objections/suggestions. Consultation with Authorities: Forwards objections/suggestions to concerned Planning/New Town Development Authority for remarks (within 7 days), which must submit their views within one month. Submission to State Government: Submits its report and proposed modifications to the State Government for sanction within two months (extendable by one month). .Sanction to Draft Structure Plan (Section 42N): Who Sanctions: State Government, after consulting the Director of Town Planning. Timeline for Decision: Within six months of receiving the draft plan from the Planning Committee (extendable by three months). Decision Options: Sanction for whole/part, without modification, or with modifications. Deemed Sanction: If the State Government fails to publish its decision within the specified period, the draft plan is deemed sanctioned as submitted.
