Sen. Matt Nunn, R-Sadieville, announced his plans to file legislation Thursday known as the HALO Act, which establishes a 25-foot safety zone around first responders while they are lawfully performing their official duties. The proposal is intended to prevent interference with first responders in dangerous, high-stress situations while preserving lawful public activity. Nunn’s proposal is modeled on legislation first enacted in Florida. The bill establishes escalating penalties for repeat violations by individuals who, after receiving a verbal warning, impede or interfere with a first responder’s official duties, threaten a first responder with physical harm or harass a first responder. The legislation applies to first responders as defined in Kentucky Revised Statutes 507.070, including peace officers, paid or volunteer firefighters, emergency medical services or rescue personnel, and personnel of private non-profit organizations that provide fire, rescue or EMS services. The bill will also apply to probation and parole officers and to university and airport police. Under the HALO Act, a first offense is a Class B misdemeanor, a second or third offense is a Class A misdemeanor and any subsequent offense is a Class D felony. The HALO Act has the endorsement of the law enforcement community.
