How To Recognize Child Abuse And Neglect | Amin Law CA PC 273d – child abuse Elements to prove the case - PC 273d To establish a crime of PC 273d, the prosecutor must prove that: 1. The defendant willfully inflicted cruel or inhuman physical punishment and/or an injury on a minor; 2. The punishment and/or injury inflicted by the defendant caused a traumatic physical condition; and 3. When the defendant acted, he/she was not reasonably disciplining the minor Examples of child abuse - PC 273d · Hitting, · Punching, · Slapping, · Kicking, · Pushing, · Shaking, · Choking, · Burning, or · Throwing a child or throwing an object at a child. Basically, any act that injures a minor can be considered abuse if it causes a traumatic condition or is “cruel and inhuman.” The term “cruel and inhuman” is not specifically defined in the CA PC. Defenses - PC 273d Common defenses include: · The allegations are false, Anger, jealously, revenge, etc. · The minor’s injuries were caused by something other than abuse, For example, bullying at school · The defendant was acting within his/her legal right to discipline the child, and/or Parents have the right to discipline their children using “corporal punishment.” They can even use an object (such as a belt or paddle) as long as: The discipline is reasonable, and The spanking causes no bodily injury · The injury was the result of an accident. Sport related accident as an example Punishment - PC 273d If charged as a misdemeanor, you’re looking at: · Up to one (1) year in county jail, and/or · A fine of up to $6,000. If charged as a felony, you’re looking at: · 2, 4 or 6 years in jail (plus an additional 4 years if the defendant has a prior felony child abuse conviction within the preceding 10 years), and/or · A fine of up to $6,000.
