(29 Jun 1995) English/Nat A formidable prosecution witness is on the stand Thursday at the O.J. Simpson trial - after an impassioned effort by the defence to keep him from testifying. Judge Lance Ito eventually agreed to limit some of the testimony from F-B-I hair and fibre expert Douglas Deedrick. A star prosecution witness, on the brink of telling the court how hair and fibres belonging to O-J Simpson were found on a glove and a hat found at the crime scene was abruptly halted by Judge Lance Ito. The defence said they only learned Wednesday of the report written by F-B-I expert Doug Deedrick about the fibres found on a cap and a glove at the crime scenes. According to the report the fibres almost certainly came from the carpeting of Simpson's Ford Bronco. SOUNDBITE: "Your honour I stand before you today in a very serious, perhaps the most egregious outrageous thing that has happened thus far." SUPERCAPTION: Johnnie Cochran, Defence Attorney. Cochran demanded to know why such crucial evidence was hidden from his team when the famous case began about nine months ago. SOUNDBITE: "And your honour it is information that is prejudicial to Mr. Simpson and this is all make no mistake about it. This is about Mr. Simpson, this is about whether Mr. Simpson can receive a fair trial, this is about a trial that started on September 26th your honour and you have gone out of your way to give us a fair trial and to have this occur when we know we are coming to the end when you have made it abundantly clear that you do not want delays, that you want to move this along, that you warned all of us that there will be preclusions if we don't comply with the laws, we have seen the sanctimonious..pious..posturing by the prosecution so many times in this case." SUPERCAPTION: Johnnie Cochran Defence Attorney. Prosecutor Marcia Clark says the matter was simply a minor error by her team, and that it shouldn't affect the defendant, since he has always received special treatment in the case. SOUNDBITE: "They have been denied nothing, there has never been a defendant in the history of this state I warrant that has had everybody bend over backwards for him like this one has." SUPERCAPTION: Marcia Clark, Prosecutor. Judge Ito disagreed saying the rarity of Broncos being sold in the Los Angeles area is critical to the defendant and his right to a fair trial. SOUNDBITE: "This report tells me how relatively few Ford Bronco automobiles there could possibly be registered in the county of Los Angeles that would have his carpet fiber in this particular car, that's very compelling circumstantial evidence." SUPERCAPTION: Judge Lance Ito. Cochran went on to reiterate a rule laid down by Ito at the beginning of the lengthy trial. Clark ended the debate with her final heartfelt request. SOUNDBITE: "I'm going to cite you Ito on the law..Ito on the law in this case and it says that if it comes to pass that there are conclusions or reports that can be reached and their was a deliberate manipulation of the process." SUPERCAPTION: Johnnie Cochran, Defence Attorney. SOUNDBITE: "If the court feels we have been remiss, than I would urge the court to penalise us personally or myself personally, but please don't..please don't penalise the proof in this case." SUPERCAPTION: Marcia Clark, Prosecutor. Ito ruled that Deedrick will be allowed to testify about tiny evidence plucked from the gloves and hat, but he will not be allowed to say that fibers found on the evidence almost certainly came from Simpson's Ford Bronco.
