September 25, 2020, I gave a floor speech regarding the need to pass my HB 5071 Law Enforcement Transparency and Accountability Act. Introduced on August 18, the legislation was denied a hearing in the Labor and Commerce Committee. On September 29, Labor and Commerce Chair Jeion Ward (D-Hampton) gave a speech responding to my 9/25 speech, to which I responded in turn. The same day, I was given two minutes to speak to my budget amendment to ensure transparency and accountability are not hindered in Law Enforcement collective bargaining agreements, which was opposed by all Democrats except Del. Lee Carter (D-Manassas). I am highly disappointed that Virginia House Democrats talk about "Black Lives Matter" but when given the opportunity to hold ensure that police are held accountable for their actions, they chose to side with the unions instead. (p. 29) "Over the years, police contracts—union CBAs—have evolved into much more than standard labor contracts. They cover the expected areas—hours, wages, benefits—but many have grown to include substantial barriers to basic accountability. We want to make sure that our officers have due process rights, but CBAs often contain provisions that go far beyond what is necessary to protect those rights. Some provisions look innocuous on their face, but they can severely impair a department’s legitimate need to investigate allegations of police officer misconduct and hold officers accountable.” 2017 Duke University Report: https://dlj.law.duke.edu/article/poli... 2018 University of Florida study updated last year: https://papers.ssrn.com/sol3/papers.c...
