Firearms Policy Coalition, the group responsible for the litigation that has resulted in the current status quo with the final rule “Factoring Criteria for Firearms with Attached “Stabilizing Braces” has reached an agreement with the Department of Justice. The DOJ will drop their appeal and discontinue defending the pistol brace rule without settlement of the financial aspects of the case. FPC will retain the right to sue for attorney’s fees in district court. This maintains the status quo of injunction and vacatur. Enforcement of the Pistol Brace rule is effectively over. However, this shows a clear lack of principle on the part of the DOJ, they simply could have asked the court to rule on behalf of the plaintiffs.
