This webinar looked at what you can and should do when it comes to the pre-action disclosure of documents. The session will provide: some practical tips on how to deal with subject access requests after an incident; and a summary of your pre-action rights to recover documents. Speaker biographies: Carly Forrest Ranked by both Chambers & Legal 500 UK, Carly is a Partner and Solicitor Advocate who has worked exclusively in the personal injury field for almost 20 years handling a full range of EL, PL and motor claims. Her specialty is in catastrophic injury claims involving head/brain injuries, severe spinal conditions and amputations as well as psychiatric and psychological disorders. Carly is also extremely experienced at handling fatal claims having defended a case which reaffirmed the law in relation to secondary victim claims and having represented her insurer clients in the UK Supreme Court. Carly routinely assists insurers and their policyholders in the immediate aftermath to coordinate post-accident investigations as well as their internal and external communication strategy and approach. She is often instructed at the outset of a claim, well before any litigation has commenced to assist develop a clear defence strategy. Carly also frequently assists clients negotiate and conclude any claim/s well in advance of any court proceedings being raised. Gemma Nicholson A Senior Associate within the Casualty team, Gemma is instructed to defend large and complex liability claims across all areas of reparation, to pursue loss recovery and to provide advice on health and safety matters. She acts for insurers, individuals, corporates and credit hire organisations and is the technical lead for the motor defence and loss recovery teams at Brodies. Gemma is a clear and concise communicator, who offers a tailored strategy and proactive approach to each and every client instruction. Jamie Reekie Jamie is a Solicitor Advocate and has a right to appear in every civil court in Scotland and the United Kingdom Supreme Court. He is an experienced litigator having specialised in dispute resolution throughout his legal career. Jamie regularly represents and advises commercial clients and private individuals in a wide variety of matters including debt recovery, insolvency and professional negligence. Although his practice has an emphasis on commercial disputes, Jamie has a keen interest in contentious trust and executry matters. He regularly advises on the obtaining of urgent and emergency court orders, protective measures and the enforcement of Scottish and foreign court orders. As well as litigation, Jamie guides and represents clients through different forms of alternative dispute resolution. Jamie has acted in a number of local and international arbitrations, appeals of arbitral awards to the Court of Session and the enforcement of foreign arbitration awards in Scotland. Rachel Lawson Rachel joined the Commercial Services Division at Brodies as a solicitor in March 2020. Since qualifying, Rachel has built up experience in advising clients in the private, public and third sectors on commercial contracts, information laws and intellectual property law. Rachel particularly enjoys giving advice on data protection matters including auditing, reporting, complex data sharing arrangements and overarching day-to-day compliance.
