Why do employees appeal? Are they not happy with the response? Or do they just not want to accept the findings of the original process? Or was there a flaw in the original process? It is always best practice to have an appeal process. This includes using the ACAS Code of Practice and their existing contract of employment. What if the employee doesn't add any evidence to their appeal and is just appealing with no reason? We would always advise to go back to the employee and get further details and evidence. Where there is no further evidence, a table top review can be conducted. If the employee has provided further evidence then we would advise for a complete rehearing. There are four steps to a rehearing. Number one; Go through the original decision. Number two; Get the reasons the employee disagrees and what further evidence they have. Number three; Carry out any further investigations. And number four; Make a decision. Once a decision has been made that is the process complete. The employee has got no further rights of appeal, unless the employee goes to ACAS, the process is complete. Thank you for watching.
