Artist Vladimir Kush and Kush Fine Art filed a lawsuit against the pop singer Ariana Grande, Universal Music Group and Freenjoy Inc. for copyright infringement and unauthorized use of one of Vladimir Kush’s most known images — the “Candle” — painted by the artist 20 years ago. In her high-profile video at the top of the music charts titled “God is a Woman,” Ariana Grande appears three times as a candlewick in the center of the infringing work. Despite the inconsequential changes and the appearance of the singer’s silhouette, as the wick the image is unmistakably taken without permission. The use of the “Candle” as a symbol can be found throughout Vladimir Kush’s artistic creations. The paintings, “Candle” and “Candle 2”, were only a part of the series of works bearing the image of the candle in the artist’s style of Metaphorical Realism created between 1998 and 2018. Vladimir Kush uses the candle as a universal symbol of the human soul and spiritual enlightenment. In the painting “Candle,” the woman as a wick holds a torch enlightening the world around her like a lighthouse “aiding the lost souls in the ocean of life.” Similarly, another of the artist’s works “To the Safe Haven,” painted in 2000, features the candle as a lighthouse, with hands that direct a beam of light toward ­­­the human souls in the turmoil of the ocean. In his painting “Theatre of Nero,” created in 2004, the shadow of Emperor Nero appears again as a wick of the candle arising from the “candled” Colosseum. The candle flame also appears as a romantic element in the painting “Daisy Games” as a “soul trembling from love.” In 2007, the Artist made the “Candle” as a silver sculpture, again featuring the woman as a wick and the center of light and spirit. The repeated use of the Candle and a woman as the wick of the flame imagery reflect Vladimir’s artistic expression of universal truths and are identifiable with his singular metaphorical vision and artistry.
