What do ICC Arrest Warrants Mean for Netanyahu & Gallant? 'If Netanyahu or Gallant enter into a jurisdiction of the Rome statute states, they have to be immediately arrested and transferred to the ICC for prosecution, a phenomenal and monumental issue'. Tayab Ali, the Director of the International Centre of Justice for Palestinians, speaks to MEE regarding the ICC’s issuing of arrest warrants for Israeli Prime Minister Benjamin Netanyahu and former defence minister Yoav Gallant, on Thursday. ‘The highest criminal court in the world has ruled that there is a case to answer for Israel directly, purposefully targeting and starving and killing Palestinians to death in Gaza over the last 12 months,’ Tayab Ali told MEE. In its statement, the ICC's Pre-Trial Chamber I, a panel of three judges, said it has rejected appeals by Israel challenging its jurisdiction. The chamber said the arrest warrants are classified as "secret" but that it has decided to release them because "conduct similar to that addressed in the warrant of arrest appears to be ongoing," referring to the ongoing Israeli onslaught on Gaza and the continued detention of Israeli captives by Hamas. ‘What Rome statute states as well as the United States, which isn't currently a party to the ICC should do, is uphold their obligations in international humanitarian law and support the ICC in its really important accountability work,’ Tayab Ali added. All 124 member states of the Rome Statute are now under an obligation to arrest the wanted individuals and hand them over to the court in the Hague. A trial cannot commence in absentia, as stipulated in Article 63 of the statute. Tayab Ali is also a Partner & the Head of International Law at leading London law firm Bindmans LLP.
