WIRETAPPING AND EAVESDROPPING Colorado is a one-party consent state, which means that people may wiretap or eavesdrop on other people’s conversations if at least one party to that conversation permits it. Therefore, people may always record their own conversations whether or not the other people involved know about it. But it is a crime to knowingly wiretap or even just listen in on other peoples’ private conversations without the consent of at least one of the parties. A common defense to wiretapping or eavesdropping charges is that the victim had no reasonable expectation of privacy. For instance, recording two people talking in a crowded restaurant is arguably legal since the two people could not realistically expect that other people wouldn’t overhear. Under CRS 18-9-303, wiretapping phones or electronic communications is a class 6 felony, which carries 12 to 18 months in prison and/or a fine of $1,000 to $100,000. But if the wiretapping involves a cordless phone, the charge is for a class 2 misdemeanor, which carries up to 120 days in jail and/or a fine of up to $750. Meanwhile, CRS 18-9-304 makes eavesdropping a class 2 misdemeanor, which carries up to 120 days in jail and/or a fine of up to $750.
