This video commences by discussing what happens when too many candidates nominate. It uses the example of the Canadian by-election in the riding of Battle River-Crowfoot, for which 214 candidates nominated, after a campaign by the 'Longest Ballot Committee'. The consequence has been that a 'write-in ballot' is being used, as it was not feasible to print a ballot paper. The video compares this to the 1999 'tablecloth ballot paper' in New South Wales and outlines the measures taken to prevent this from happening again. It explains how the High Court, in Mulholland, upheld one of those measures, which had been replicated at the federal level. The video then discusses what happens when no one nominates, or too few candidates nominate. It discusses an early example of this in Australia from 1848, when the refusal to nominate candidates was a form of political protest. It concludes by outlining the current provisions in the New South Wales Constitution Act and the Electoral Act which deal with these issues.
