http://www.Oginski-Law.com 516-487-8207 [email protected] You have a New York medical malpractice case or an accident case or maybe even a wrongful death case and your matter is coming up for trial. There is a knock at your door and a gentleman says he has a piece of paper for you. You take the paper, read it and see that it is a subpoena that compels you to come into court and testify. But there's something bizarre about it. It's your own case! You read further and you learn that the subpoena is being served on you by the defense lawyers who represent the people you have sued in your lawsuit. How could that possibly happen? You frantically call your attorney asking what to do. It turns out that the defense lawyers did not believe that you were going to come in voluntarily and testify in your own case. That may not make much sense since you, as the injured victim, are required to put on evidence and testimony to support your claim that you suffered significant injury as a result of someone else's wrongdoing. In any event, the defense lawyer has now served you with a subpoena. Do you need to come into court and testify at that particular date and time? What will happen if you are unable to make yourself available on that date? Will you be held in contempt of court? Will your case be affected if you cannot come in on that date but can come in on another date? Doesn't the defense attorney know that you will be in court each day listening to witnesses give testimony? Are the defense attorneys really allowed to serve a subpoena on you?
