It could happen close to trial. But they don't want to negotiate directly with your attorney. They want a buffer. They want someone to help them put pressure on your lawyer to settle. That someone should be impartial. That someone shouldn't care who wins or who loses. That someone should be trustworthy. That someone is usually a judge. But the judge assigned to your case likely doesn't have the time to sit with both parties for hours to hammer out a settlement. So what can the litigants do if the judge assigned to the case isn't ideal to try and negotiate? The answer is mediate the case. Mediation is a private negotiation using retired judges. Each side agrees to the mediator to use. On the day of the mediation, each side gives a brief presentation putting their best arguments forward. Then, each side meets with the judge privately to let him know where they stand on settlement negotiations.
